aforesaid Hatter of the other part Whereas by Indenture of Lease bearing
date the - day of November One thousand eight hundred and nine made
between Isaac Patton and Charles McAlister, both then of Belfast in the
County of Antrim aforesaid, Merchants of the one part and Thomas May of
Belfast, aforesaid Cotton Manufacturer of the other part, they the said
Isaac Patton and Charles McAlister did demise Grant Let and to Farm Let?
unto the said Thomas May his Heirs Executors Administrators and ??signs All
that piece or parcel of Building Ground situate lying and being on the West
side of the continuation of Arthur Street in the said Town of Belfast
containing in part next said Street Forty-six feet and extending in depth
backwards to Donegall Square East One Hundred and sixty-six Feet be the same
more or lefs bounded on the Fourth by a Tenement occupied by Mr. Thomas
Vance on the west by the said Street called Donegal Square East and on the
North by a Lane or Street of twelve feet that was to run from Arthur Street
to said Street called Donegall Square East with all the Rights Numbers and
Appurtenances therewith belonging or on any wise appertaining excepting out
of that demise all matters excepted in and by the Original Lease of said
Premises To Hold unto the said Thomas May his Heirs Exeors Admors and
Afsigns from the first day of November then Instant for and during the
Natural Lives and Life of the Most Honble George Augustus Marquis of
Donegall, The Right Honble George Chichester Earl of Belfast and The Right
Honble Edward Chichester first and Second Sons of the said Marquis and the
Survivors and Survivor of them and from and immediately after the decease of
such Survivor for and during all the then Residue and Remainder of the Term
of Eighty ? Years and one half Year to be Computed from the first day of
November then Instant fully to be complete and ended Subject to the yearly
rent of Fifty two Pounds six shillings and six pence Sterling Payable half
Yearly and to the several Clauses Covenants and Agreements on the Tenant or
Lefsees part un said Indenture of Lease Reserved and contained as by said
Indenture of Lease Referrence being had thereto may more fully and at large
appear And Whereas the said Piece or Parcel of Building Ground and Premises
with the Appurtenances afterwards by ? Afsignments or otherwise became and
now a Legally Vested in William Tennent Party hereto And Whereas the said
Robert Bailie hath come to an Agreement with the said William Tennent for
the Absolute Purchase of his Interest of in and to the said Recited
Indenture of Lease and the Premises thereby demised for the Sum of Four
Thousand four hundred Pounds Sterling which he the said William Tennent
hath Agreed to Accept for the same Now this Indenture
Witnefseth that the said William Tennent inpursuance and Executor of the
said Agreement and for and in Consideration of the said Sum of Four Thousand
four hundred pounds Sterling to him in hand paid by the said Robert Bailie
at or immediately before the Ensealing and delivery of these presents the
Receipt whereof he the said William Tennent doth hereby acknowledge and
thereof and of and from the same doth Acquit Exonerate Release and Discharge
the said Robert Bailie his Heirs Exeors Admors and Afsigns for Ever by these
presents he the said William Tennent Hath Granted Bargained Sold Aliened
Released Transferred and made over and Doth by these presents Grant Bargain
Sell Alien Remise Release Transfer and makeover unto the said Robert Bailie
(in his actual pofsession now being by Virtue of a Bargain and Sale to him
thereof make for one whole year by Indenture bearing date the day next
before the day of the date of these presents in Consideration of Five
Shillings Sterling and by force of the Statute for Transferring Uses into
pofsession and to his Heirs Exeors Admors and Afsigns All That the said
Piece or Parcel of Ground situate lying and being on the West Side of the
Continuation of Arthur Street in the town of Belfast aforesaid containing in
front next said Street Forty-six Feet and extending in depth backwards to
Donegall Square East One Hundred and sixty six feet be the same lore or lefs
bounded as herein before and in the said Recited Lease is particularly
mentioned together with all Houses Out Houses Edifices Buildings Yards
Stables Coach Houses Rights Numbers Incidents Appendances and Appurtenances
to said Premises or any part thereof belonging or in any wise appertaining
and also the Reversion and Reversions Remainder and Remainders yearly and
other Rents Duties and Profits of all and Singular the said Premises and
every or any part or parcel of the same with their and every of their
Appurtenances and likewise all the Estate Right Title Interest Use Just
Pofsession Property Profit Claim and Demand whatsoever of the said William
Tennent of his Heirs of in ? to the said whole premises hereby given or
Granted as aforesaid and every part and Parcel thereof with their
Appurtenances, and also the said Recited Indenture of Lease and all other
Writings Evidences Nuniments Deeds and papers whatsoever touching or
accessing the said premises and every or any part or parcel thereof that are
in the Power Custody or Pofsession of the said William Tennent To Have and
to Hold all and singular the said piece or Parcel of Ground Tenements and
Premises hereby Granted Released and Afsigned or intended to be hereby
Granted Released and Afsigned and every or any parcel thereof with their and
every of their Rights Members Incidents and Appurtenances whatsoever unto
the said Robert Bailie his Heirs Exeors Admors and Afsigns from the First
day of May last past for and during the Natural Lives and Life of The Most
Noble George Augustus Marquis of Donegall, The Right Honble George
Chichester Earl of Belfast, and The Right Honble Edward Chichester the
eldest and Second Sons of the said Marquis and the Survivors and Survivor of
them and from and immediately after the decease of such Survivor for an
during the then Residue and Remainder of said Term of Eighty-nine and one
half years to Commence and be Computed from the first day of November which
was in the year of our Lord One thousand eight hundred and Nine fully to be
Completed and ended And the said William Tennent doth hereby for himself his
Heirs Exeors and Admors Covenant Promise Grant and Agree to and with the
said Robert Bailie his Heirs Exeors Admors and Afsigns in manner and form
following that is to say that he the said William Tennent his Heirs Exeors
and Admors all and singular the Premises herein before Bargained and Sold
Remised and Released as aforesaid against him the said William Tennent his
Heirs Exeors and Admors and all and every other person or persons whatsoever
Lawfully Claiming ordering or that shall or may Claim or Derive by from or
under him or them or any of them x x shall and will at all times during the
continuance of this present Grant and Conveyance Warrant and defend by these
Presents And the said William Tennent for himself his Heirs Exeors or Admors
doth Covenant Promise Grant and Agree to and with the said Robert Bailie his
Heirs Exeors Admors and Afsigns That the said Recited Indenture of Lease is
a good and sufficient Lease in the Law and is now in full force and effect,
And that he the said William Tennent hath not done any Act or ? to incumber
the said Premises but that the same are Free and Clear and freely and
Clearly and absolutely Acquitted Exonerated and discharged or otherwise well
and sufficiently served? harmlefs and kept Indemnified of and from all
former and other Gifts Grants Bargains Sales Mortgages Afsignments
Recognizances Extents Leases Demises Surrenders Rent and Arrearages of Rent
and all Incumbrances whatsoever Subject neverthelefs to the payment of the
Yearly Rent and to the performance of the several Covenants Conditions and
Agreements on the Tenant or Lefsees part in and by the said Recited
Indenture of Lease Reserved and contained And also that he the said Robert
Bailie his Heirs Exeors Admors and Afsigns shall and may (under the Rent
Covenants and Agreements in the said recited Lease) at all times hereafter
during all the rest Residue and Remainder of the said Tern for Lives and
Years as aforesaid which is yet to Come and unexpired peaceably and quietly
enter into Have Hold Occupy Pofsess and Enjoy the said Parcel of Ground and
Premises hereby Conveyed and every part and parcel thereof with the
Appurtenances without the ?et Trouble Hindrances Molestation or denial of
him the said William Tennent his heirs, Exeors or Admors or any other person
or persons whatsoever lawfully Claiming the said Premises or any part
thereof by from or under him them or any of them or by his or their Means or
Procurement And further that he the said William Tennent his Heirs Exeors &
Admors and all and every other person or persons and his and their Heirs
Exeors and Admors any thing having or Claiming in the said Parcel of Ground
and Premises above mentioned or any part thereof shall and will from time to
time and at all times hereafter upon the Request and at the Costs and
Charges in the Law of the said Robert Bailie make do and Execute or Cause to
be made done and Executed all and every such further and other Lawful and
responsible Grants Acts and Allowances in the law whatsoever for the further
better and more perfect Granting and Conveying of the said Parcel of Ground
and Premises above mentioned with the Appurtenances unto the said Robert
Bailie his Heirs Exeors Admors and Afsigned to hold unto the said Robert
Bailie his Heirs Exeors Admors and Afsigned for and during the said Term
hereby granted as by the said Robert Bailie his Heirs Exeors Admors or Afsigns or they or their Counsel learned in the Law shall be reasonably
